Terms of Service

Welcome to FarePromise. These Terms of Service (“Terms”) govern your use of the FarePromise website at fare-promise.com and any related services (together, the “Service”). The Service is operated by FarePromise LLC, a limited liability company organized in Arizona (“FarePromise,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What FarePromise Is

FarePromise is a travel-planning tool and rewards program. We help you plan trips and we provide links to third-party travel providers and booking sites (such as airlines, hotels, and travel marketplaces) where you can book travel. We are not a travel agency, tour operator, or seller of travel.We do not sell, book, or provide any flights, hotels, car rentals, tours, or other travel products ourselves. All bookings and payments happen directly between you and the third-party provider, subject to that provider’s own terms and conditions.

2. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information in your account and for keeping your login credentials secure. You are responsible for all activity that happens under your account.

3. Trip Planning Content

Our planning features generate suggested itineraries, estimated prices, and recommendations using automated tools. This information is provided for general informational purposes only. Estimated prices, availability, travel times, and other details are not guaranteed and may differ from what a provider actually offers. Always confirm all details directly with the provider before booking.

4. Affiliate Relationships

When you click a booking link and complete a purchase with a third-party provider, we may earn an affiliate commission at no additional cost to you. This does not change the price you pay. Our recommendations are not influenced by whether a provider has an affiliate relationship with us.

5. Price Drop Protection & Credits

FarePromise offers an optional rewards feature we call Price Drop Protection, under which you may earn account credits if the monitored price of an eligible booking decreases. This feature is a discretionary rewards program, not insurance, a financial product, or a guarantee of savings. Your use of credits is governed by our Rewards & Credit Terms, which are part of these Terms.

6. Subscriptions (FarePromise Pro)

FarePromise Pro is a paid subscription billed on a monthly or annual basis through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. You can cancel at any time, and your Pro features will remain active through the end of your current billing period. Except where required by law, payments are non-refundable. We may change subscription pricing with reasonable advance notice.

7. Acceptable Use

You agree not to misuse the Service, including by: providing false booking information or fraudulent proof of booking; attempting to obtain credits you did not legitimately earn; interfering with or disrupting the Service; scraping or copying the Service without permission; or using the Service for any unlawful purpose. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are engaged in abuse or fraud.

8. Third-Party Services

The Service relies on and links to third parties, including travel providers, booking marketplaces, payment processors, and gift-card fulfillment partners. We are not responsible for the products, services, content, or actions of any third party. Your dealings with third parties are solely between you and them.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any estimate, recommendation, or price will be accurate.

10. Limitation of Liability

To the fullest extent permitted by law, FarePromise and FarePromise LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) fifty U.S. dollars ($50).

11. Indemnification

You agree to indemnify and hold harmless FarePromise and FarePromise LLC from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Changes to the Service or Terms

We may modify or discontinue any part of the Service at any time. We may also update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Arizona.
